Nothing in these Terms & Conditions affects any statutory rights you have as a consumer under applicable UK law.

You may use our website for lawful personal and shopping purposes.

Products
We aim to provide accurate descriptions of the products offered through our website.
Unless clearly stated otherwise, products advertised as genuine branded Trading Card Game products are supplied as genuine products sourced through appropriate suppliers or distributors.
Product packaging, promotional materials and minor design details may occasionally differ from photographs shown on our website, particularly where manufacturers update packaging or product presentation.
Product images are provided to help illustrate the product. Colours and appearance may also vary slightly depending on your device or display.
These differences do not affect your rights where goods are faulty, materially different from their description or otherwise do not meet the standards required by law.
Trading Card Game Products
Many products sold by Card Avenue Ltd are sealed collectible products, including booster packs, booster boxes, Elite Trainer Boxes, tins, collection boxes and other Trading Card Game products.
The contents of products containing randomly selected cards are determined by the manufacturer.
Unless a particular card or guaranteed item is expressly included in the product description, purchasing a sealed Trading Card Game product does not guarantee that you will receive any particular card, rarity, character, artwork or estimated market value.
Card Avenue Ltd does not guarantee the future collectable value, resale value, grading outcome or investment performance of any product or card.
This does not affect your rights where a product is faulty, damaged, counterfeit, incorrectly supplied or not as described.
Availability
All products are subject to availability.
Adding a product to your basket does not reserve that product.
We may apply reasonable purchase limits to certain products, including limited releases, high-demand products and promotional items.
Where purchase limits apply, they may be shown on the relevant product page or during checkout.
We reserve the right to decline an order before it has been accepted where, for example:

the product is unavailable;
-
an incorrect price or product description has been displayed;
-
a purchase limit has been exceeded;
-
payment cannot be authorised;

we reasonably suspect fraud or misuse;

we cannot deliver to the address provided; or

we are otherwise unable to fulfil the order.
If we are unable to fulfil an order and payment has already been taken, the relevant amount will be refunded.
Prices
Prices displayed on our website are shown in Pounds Sterling (GBP).
Prices include VAT where applicable.
Delivery charges are shown separately where applicable and will be displayed before you complete your purchase.
We may change product prices at any time, but price changes will not affect an order that we have already accepted.
Pricing Errors
We take reasonable care to ensure that prices displayed on our website are correct.
However, mistakes can occasionally occur.
If we discover an obvious pricing error before your order has been accepted, we may contact you to give you the option of purchasing the product at the correct price or cancelling the order.
We will not charge you an increased price without your agreement.
If we cannot contact you regarding an obvious pricing error, we may cancel the affected order and refund any payment already made.
Once an order has been accepted, we will not increase the agreed price except where required by law or where you expressly agree to a change.
Placing an Order
When you submit an order through our website, you are making an offer to purchase the products shown in your order.
After placing your order, you will normally receive an automated order confirmation email.
The order confirmation confirms that we have received your order. It does not necessarily mean that we have accepted your offer to purchase.
A contract between you and Card Avenue Ltd is formed when we accept your order, normally when we send you confirmation that your order has been dispatched.
If we accept only part of an order, the contract will apply only to the products that we have accepted.
Payment
We accept the payment methods displayed during checkout.
Payment processing may be provided by Shopify and/or third-party payment providers.
You confirm that you are authorised to use the payment method provided when placing your order.
Payment may be authorised or collected before we formally accept your order.
If we subsequently decline or cancel an order before acceptance after payment has been taken, we will arrange a refund of the relevant amount.
Your bank or payment provider may take additional time to process a refund after we issue it.
Order Information
You are responsible for checking that the information supplied with your order is accurate, including:

Order Cancellation by Card Avenue Ltd
Before an order has been accepted, we may decline or cancel it for reasonable reasons, including:

stock becoming unavailable;

an obvious pricing or listing error;

payment failure;
-
suspected fraudulent activity;
-
breach of a clearly stated purchase limit;

inability to deliver the order; or
-
circumstances that make fulfilment impossible or unlawful.
Where payment has already been taken for an order that we cancel, we will refund the appropriate amount.
After we have accepted an order, we will only cancel it where we have a lawful or contractual right to do so.
Pre-Orders
Certain products may be made available for pre-order before their official release date.
Any release date or expected dispatch date shown for a pre-order product is based on information available to us at the time and may be subject to change by manufacturers, distributors or suppliers.
We will make reasonable efforts to dispatch pre-orders as close to the expected release date as possible, but release dates are not guaranteed unless we expressly state otherwise.
If a manufacturer or distributor changes a release date, we will update the expected timing where reasonably possible.
If a pre-order product is cancelled by the manufacturer or supplier and we cannot fulfil your order, we will cancel the affected product and issue an appropriate refund.
Where an order contains both in-stock and pre-order products, we may hold the order until all products are available for dispatch, as explained in our Shipping Policy or on the relevant product page.
Any additional terms clearly displayed on a pre-order product page will also apply to that pre-order.
Product Allocations
Highly anticipated Trading Card Game releases may sometimes be subject to supplier or distributor allocations.
This means that we may receive fewer units than originally expected.
We will take reasonable steps to avoid accepting orders that we cannot fulfil.
If an unexpected allocation means we cannot fulfil all or part of an order before it has been accepted, we will contact affected customers and refund any amount paid for products we cannot supply.
We will not knowingly substitute a different product without your agreement.
Promotions and Discount Codes
We may occasionally offer promotions, discount codes or special offers.
Specific terms may apply to individual promotions.
Unless otherwise stated:

promotional codes have no cash value;

only one promotional code may be used per order;

promotions cannot normally be applied retrospectively to previous purchases;

offers are subject to availability; and

discounts apply only during the advertised promotional period.
We may refuse or cancel the use of a promotional code where we reasonably believe it has been obtained, distributed or used fraudulently or contrary to the stated promotional terms.
Nothing in this section affects an order that has already been validly accepted except where permitted by law.
Shipping and Delivery
Orders are processed and delivered in accordance with our Shipping Policy.
Delivery charges and available shipping options will be shown during checkout.
Any delivery times displayed on our website are estimates unless expressly stated otherwise.
Card Avenue Ltd remains responsible for your order until it has been delivered to you, or to another person you have nominated to receive it, except where applicable law provides otherwise.

Risk and Ownership
The risk of accidental loss or damage to products generally passes to you when the products are delivered to you or to a person you have nominated to receive them.
Ownership of products passes to you once we have received payment in full and the products have been delivered, subject to applicable law.
Your Right to Cancel an Online Order
If you are purchasing as a consumer, you will normally have a legal right to change your mind and cancel an online purchase within 14 days of receiving the goods, subject to certain legal exceptions.
You do not need to provide a reason for exercising this right.
If an order contains multiple goods delivered separately, the cancellation period may run from the date on which you receive the last applicable item, as provided by law.
After notifying us that you wish to cancel, you will normally have a further 14 days to return the goods.

Handling Returned Products
Where you exercise a legal right to cancel, you may inspect and handle the goods to the extent reasonably necessary to establish their nature, characteristics and functionality, similar to what you would reasonably be able to do in a physical shop.
Because many Trading Card Game products are sold as sealed collectables, opening factory-sealed packaging may significantly reduce their value.
Where applicable law allows us to do so, we may make an appropriate deduction from a refund where your handling of a returned product goes beyond what is reasonably necessary to inspect it and has reduced its value.
We will not use this provision to restrict any statutory right you have where a product is faulty, damaged, counterfeit, incorrectly supplied or not as described.
Faulty, Damaged or Misdescribed Products
Products supplied by Card Avenue Ltd must meet the standards required by applicable consumer law.
Among other things, goods must be:

fit for their intended purpose; and

as described.
If a product is faulty, damaged when supplied, incorrectly supplied or materially different from its description, you may have legal rights to a refund, repair, replacement or other remedy depending on the circumstances.

Where you exercise a statutory right to cancel an online order, any refund of the original delivery charge will be handled in accordance with applicable law.

Unless expressly stated otherwise, Card Avenue Ltd is an independent retailer and is not affiliated with, sponsored by or endorsed by the owners of the Pokémon brand or other third-party brands sold through our website.
